Federal prosecutors have considered four possible charges against Hunter Biden including three tax crimes and a charge related to a gun purchase. Two charges are misdemeanor counts for failure to file taxes.
They are also looking at hitting Hunter with a single felony count of tax evasion related to a business expense and the gun charge which is a potential felony.
The decision on which charges to file will be made by U.S. Attorney David Weiss, who was appointed by President Donald Trump and retained by Biden. But AG Garland surely will have the final say.
Two senior law enforcement sources told NBC News there is a “growing frustration” inside the FBI over the kid glove treatment of Hunter.
Biden’s lawyer Chris Clark said in a statement:
“It is a felony for an IRS agent to improperly disclose information about an ongoing tax investigation.
“The IRS has incredible power, and abusing that power by targeting, embarrassing, or disclosing information about a private citizen’s tax matters undermines Americans’ faith in the federal government
“Unfortunately, that is what has happened and is happening here in an attempt to harm my client.
“It appears this IRS agent has committed a crime, and had denied my client protections that are his right.”
