Don’t ever count out Donald Trump. He is a fighter and as with anything, the more you try the more luck you have and Trump just got an incredibly lucky break that has the Dems seething in his Florida case.
It looks like Trump’s favorite judge will preside over his case and the left is already trying to get her removed.
Guardian reporter Hugo Lowell said: “Trump-appointed US district court judge Aileen Cannon was listed on the summons sent to Trump yesterday, per ppl familiar — indicating she may be the presiding judge. Cannon granted Trump a special master during the investigation last year. Confirming ABC News.
MSNBC analyst Joyce Alene immediately tried to calm down the panicked left saying Garland will try to remove Cannon. If they try to remove Cannon this thing will turn into the biggest farce in history right before our eyes.
Alene said:
“Before everyone gets too spun up about reports Judge Cannon has been assigned to the Trump case, a little law.
“I used to be an appellate chief in the 11th Circuit (where Florida is) and I litigated a few appeals where we asked the court of appeals to order a judge to recuse.
“Altho a judge’s behavior in court generally doesn’t form the basis for recusal, the 11th Circuit has ordered “reassignment” where a judge leans so heavily for a defendant they call their objectivity in the eyes of the public into question.
“This is persuasive authority that Judge Cannon must step aside if the case falls to her as a permanent assignment.
“Her court & certainly the 11th won’t tolerate the damage it would do to their credibility if she failed to voluntarily recuse.”
According to The New York Post:
The federal indictment lodged against former president Donald Trump includes seven charges that carry a maximum 75-year prison sentence if convicted on all counts.
The 76-year-old former commander-in-chief was indicted by a federal grand jury Thursday on criminal charges relating to his alleged mishandling of classified White House documents that were recovered at his Mar-a-Lago estate in Florida and allegations he tried to obstruct the government’s attempts to retrieve them.
The charges against Trump include: willfully retaining the national defense documents, conspiring to obstruct justice, withholding the documents, corruptly concealing the records, concealing a document in a federal investigation, scheming to conceal and making false statements, sources told ABC News.
All seven charges “break out from an Espionage Act charge,” his lawyer Jim Trusty confirmed to CNN.
According to ABC:
The summons sent to former President Donald Trump and his legal team late Thursday indicates that U.S. District Judge Aileen Cannon will be assigned to oversee his case, at least initially, according to sources briefed on the matter.
Cannon’s apparent assignment would add yet another unprecedented wrinkle to a case involving the first federal charges against a former president: Trump appointed Cannon to the federal bench in 2020, meaning that, if Trump is ultimately convicted, she would be responsible for determining the sentence – which may include prison time – for the man who elevated her to the role.
A federal grand jury voted to indict Trump on at least seven federal charges late Thursday as part of an investigation into his handling of classified documents, sources familiar with the matter told ABC News. The indictment comes after more than 100 documents with classified markings were found at Trump’s Mar-a-Lago resort in August 2022.
